RE: LETTER OF ENGAGEMENT: CASUAL EMPLOYMENT:
On behalf of Open Care Community Services Pty Ltd (t/a Open Care Connect, NDIS: 4-JU2I9UJ, ABN: 22 668 873 694), it is with great pleasure that we confirm your engagement in the role of on a casual basis, subject to the terms and conditions set out in this letter.
1. COMMENCEMENT DATE
Your employment will be on a casual basis under the Fair Work Act 2009 s.15A, commencing on . Casual employment has no firm advance commitment; you will be offered work as required and you have the right to accept or decline any offer.
2. POSITION AND CLASSIFICATION
Your position is , classified under the Social, Community, Home Care and Disability Services (SCHADS) Award 2010 at the applicable pay point. Casual employees are engaged under the SCHADS Award 2010 at the applicable pay point, plus a 25% casual loading. This letter of engagement, your Position Description, and the SCHADS Award together constitute your employment agreement.
3. REMUNERATION
Your hourly rate will be $ per hour inclusive of casual loading (25%), paid fortnightly in arrears to your nominated bank account. This rate is inclusive of applicable Award allowances unless separately itemised. No superannuation entitlement accrues on the casual loading component.
4. HOURS OF WORK
As a casual employee, you have no guaranteed minimum hours per week. You will be offered work as operationally required. You have the right to accept or decline any offer of work.
4A. CASUAL CONVERSION
After 12 months of casual employment, if you have worked on a regular and systematic basis for at least 6 months and the work could continue without significant change, you may request conversion to permanent employment under Fair Work Act 2009. See fairwork.gov.au/casualconversion for further information.
5. PROBATIONARY PERIOD
A probationary period of 3 months applies from commencement. Either party may end the engagement at any time by providing notice in accordance with the applicable Modern Award.
6. PLACE OF WORK
Your primary place of work will be . Open Care Connect may, at its reasonable discretion, require you to work at other locations with reasonable notice, subject to the provisions of the applicable Modern Award.
7. NDIS COMPLIANCE REQUIREMENTS
This offer is conditional on the maintenance of all of the following throughout your employment:
- A current NDIS Worker Screening Check clearance (mandatory if your role is classified as a Risk Assessed Role; see attached Position Description)
- A current Working With Children Check (WWCC) (Victoria)
- A current National Police Check, renewed in line with OCC policy (3-year cycle)
- Completion of the NDIS Orientation Module within 3 months of commencement (if not already completed)
- Any role-specific qualifications, certifications, or licences specified in your Position Description
If at any time during your employment any of the above lapses or is revoked, you must immediately notify your supervising manager. You may not continue in a Risk Assessed Role until the relevant clearance is restored.
8. LEAVE ENTITLEMENTS
As a casual employee, you do not accrue paid leave entitlements. Casual loading compensates for this in lieu of annual leave, personal leave, and public holiday entitlements. Parental leave and community service leave apply in accordance with the Fair Work Act 2009.
9. CODE OF CONDUCT AND POLICIES
As a condition of employment, you are required to read, sign, and comply with the Open Care Connect Code of Conduct Agreement, the Privacy and Confidentiality Agreement, and all OCC policies and procedures. Copies will be provided on commencement. Policies may be updated from time to time; you will be notified of material changes.
10. CONFIDENTIALITY
You must not, during or after your employment, disclose, copy, or use any confidential information relating to Open Care Connect, its participants, staff, or business affairs, except as required to perform your role duties. This obligation survives the termination of your employment.
11. TERMINATION
Either party may end a casual engagement at any time with 1 hour's notice for a single shift, or by providing notice as stipulated in the SCHADS Award 2010 to end the casual employment relationship. Open Care Connect reserves the right to terminate immediately for serious misconduct.
12. GOVERNING LAW
This letter of engagement and your employment are governed by the laws of Victoria, Australia, and the Fair Work Act 2009 (Cth).
